Practical notes

  • Carrier and registration requirements: In the US, A2P 10DLC and toll-free registration reviewers typically check that your terms and privacy policy include STOP/HELP instructions, a “message and data rates may apply” line, message frequency, and a statement that mobile opt-in data isn’t shared with third parties for marketing. The language in section 8 is there for that reason.
  • Opt-in form language: Your signup form should show a short version of these terms next to an unchecked consent box, with links to the full terms and privacy policy.
  • Marketing texts: If you send promotional messages, the TCPA generally requires prior express written consent, and you should follow quiet-hours rules. State laws (e.g., Florida, Oklahoma) can add restrictions.
  • Not legal advice: I’m not a lawyer, and requirements change, so have counsel review the final version, especially if you’re sending marketing messages or operating outside the US.
